Negotiation

With the skyrocketing cost of litigation, clients are more frequently seeking to settle matters outside court. With the landscape of litigation changing dramatically, negotiating skills are fast becoming the lynchpin of a young lawyer’s repertoire.

This competition, sponsored by Corrs Chambers Westgarth, provides a fantastic platform for students to develop skills in diplomacy, dispute resolution, communication skills and the ability to quickly evaluate and advocate for the needs of your client. The competition requires very little preparation and is perfect for law students of all year-levels as it requires little reliance on matters of substantive law.

The competition simulates ameeting between two pairs of lawyers. Each team is seeking to represent and advocate for the needs of their client. There is a common set of facts known to all participants, as well as confidential information given exclusively to each team. The purpose of the competition is for each party to come to an agreement that best meets their client's goals.

The Framework of the Competition:

Competitors receive their brief approximately 2-3 hours before the
scheduled negotiation.

Within a half an hour period, the teams mustthen try to reach an agreement which best meets their clients’ instructions as outlined in the brief.

Following the negotiation, each team is given a short time (approximately 10 minutes) to evaluate their own performance beforethe judge and answer any questions the judge may have. This gives competitors an opportunity to explain their tactics as well as gain invaluable feedback.

Negotiation for 2010 will take place in Semester 2, with Round 1

Please note that all competitors are required to attend the competition in business attire.
